Terms of Use
DRAFT for review by qualified lawyers in the United States. Not yet legally reviewed. Version 2026-11-03-v30-draft.
1. Agreement
These Terms of Use ("Terms") are an agreement between you and Lenvetal LLC, a California limited liability company doing business as QRemo, 1015 Wall St, Suite 111, Los Angeles, CA 90015, USA ("QRemo", "we"). By creating an account or using the QRemo app or website (the "Service") you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. The Service is offered only in the United States. You must be at least 18 years old, or the age of majority in your state if higher. If you use QRemo for a business or other organization, you accept these Terms for it as well and confirm that you may do so; any law that protects you as a consumer still applies where it does. Section 13 contains rules that depend on where you live, and section 15 contains terms required by the app stores.
2. What QRemo does, and where its dates come from
Please read this carefully. QRemo's dates are reminders, not safety advice. Times after opening are general guidance, not a promise about your specific product. Always check your product's label, and for medicines and baby products ask your pharmacist. For medicines and infant formula, QRemo only tracks the printed expiry date while the package (or, for a medicine packed one dose at a time, each dose) is sealed. Once opened, QRemo does not provide or suggest any time. Any reminder you set is your own and is not checked by QRemo. The printed date may be read incorrectly; always check it against the package. Follow the label, the leaflet, and your pharmacist or doctor. For other products, QRemo makes no estimates of how long a product lasts once opened. It gives a time after opening only in this order: first, official government sources (USDA FoodKeeper and FoodSafety.gov), and when more than one of them gives a time, QRemo uses the shortest; if none of them gives a time, the maker's own after-opening instruction, either printed on your product's label and read from your photo, or found on the maker's website, which QRemo uses only after you confirm it; otherwise, QRemo suggests nothing and you enter the time yourself. If your product's printed label gives a different or shorter time than the one QRemo shows, follow the label. Official, label and maker's-website times hold only if you follow the storage conditions on the product. A printed expiry or best-before date is for the unopened package. QRemo keeps a record of the source of every date (section 14).
QRemo helps people, families and teams, including professionals and businesses, record when products were opened and reminds them before items may no longer be good to use. Every item in the app shows where its date comes from:
- Official sources: for many foods, the times after opening published by government agencies: the U.S. Department of Agriculture's FoodKeeper data ("USDA FoodKeeper"); and the Cold Food Storage Chart on FoodSafety.gov (U.S. Department of Health and Human Services, https://www.foodsafety.gov/food-safety-charts/cold-food-storage-charts), for opened hot dogs, luncheon meat, liquid egg substitutes and opened canned ham. Where a source gives a range, we use the shortest time in it. When more than one source gives a time for the same food, QRemo uses the shortest one and shows each source with its time, for example "Official sources: FoodSafety.gov: 3 days · USDA FoodKeeper: 5 days. QRemo uses the shortest." We count the time from the day you mark the item opened. For some foods FoodKeeper counts its time from the day of purchase rather than from opening, so if you open such a food some time after buying it, the real time left may be shorter. These sources are general U.S. guidance. QRemo matches your product to the types of food these sources list, and that match can be wrong; the source and food type are shown in the app so you can check them. The guidance may not fit your specific product or how it was stored, and the agencies can change it. The version of the FoodKeeper data used is kept in the source records, and the FoodSafety.gov figures are checked against those pages at least every 6 months and whenever we learn that a source has changed; the date of the last check is kept with the figures.
- Product label: the maker's own after-opening instruction or period-after-opening symbol (for example "12M") printed on your product's label, read from your photo by automated image recognition (AI). QRemo keeps a time read this way only if its number appears in the text the AI read from the label, but AI can still misread a label, so check the time against your product. If your label gives a shorter time than one QRemo shows, follow the label. This source is never used for medicines or infant formula.
- From the maker's website: when no official source gives a time after opening, and the product has a known brand and is not a medicine or infant formula, QRemo's AI may search the web for the maker's own after-opening instruction. QRemo accepts a result only if the page came up in that search and is on a website whose address contains the brand's name. QRemo's server then opens the page itself and keeps the sentence only if it appears there word for word and the number of days is written in that sentence. The app shows the sentence in quotation marks, with the website's name and a link to the page, and uses it only if you tap "Use This: N days"; it is never applied automatically. The item then shows "From the maker's website (site): '…'", along with "Follow the storage conditions on the product." These checks reduce errors but do not remove them: the AI can still pick the wrong product, product line, size or page (for example another flavour or variety, or a product sold in another country), and a website whose address contains the brand's name is not necessarily run by the maker. Read the quoted sentence and check that it matches your product before you use it. Makers can change or remove their websites at any time, and QRemo shows what the page said when it was checked. A result for a product, including a finding that there is none, is kept for up to 90 days and shared with everyone who looks up the same product; it holds only public facts about the product (the page address, the sentence and the time) and no personal information. QRemo is not affiliated with, sponsored by or endorsed by the makers whose websites it quotes, and each maker is responsible for its own instructions. If the printed label on your product gives a different or shorter time, follow the label. This source is never used for medicines or infant formula, or when an official source gives a time.
- Printed date: the expiry or best-before date printed on the package, read from your photo by AI, read from the square 2D code on some medicine packs, or entered by you. AI can misread a date; for medicines and infant formula the app asks you to check it against the package. A printed date is for the unopened package. If you choose it for a food that is already open, the app warns you that most foods go bad much sooner once opened, and when you mark as opened a sealed item (other than a medicine or infant formula) that has no after-opening time, the app asks you to enter one.
- Barcode: when you scan a barcode, QRemo checks every source available to it at the same time and shows which ones knew the product: QRemo's own barcode table (products other users saved or confirmed), openFDA and the FDA's National Drug Code Directory (used only to name a medicine from its barcode), the U.S. Department of Agriculture's FoodData Central branded foods data, and the Open Food Facts, Open Beauty Facts, Open Pet Food Facts and Open Products Facts databases, which are built by volunteers and published under the Open Database License (see section 16). Only when none of those knows the product does QRemo ask UPCitemdb, a commercial retail barcode database. QRemo's AI then names and classifies the product from what these sources say. The square 2D code on some medicine packs gives the expiry date and lot number directly. These databases are not run by QRemo and can be incomplete or wrong; check what the app shows against your product.
- Not opened yet: items you mark as not opened, or whose pieces are each sealed (medicines packed one dose at a time, for example blister packs, sachets or single-dose vials), follow only the printed date until you mark them as opened. The printed date assumes the product was stored as its label says; heat, light, moisture or a broken seal can make it go bad sooner.
- No official time: QRemo does not estimate how long any product lasts once opened, whether by AI or from its built-in list of common products. When no official source, no label instruction and no instruction from the maker's website gives a time after opening, QRemo suggests nothing: the app says "There's no official time for this product once opened. Check the label, or enter your own." and you enter the time yourself, shown as "Set by you". If QRemo finds the maker's instruction and you do not use it, you also enter the time yourself.
- Estimate only (earlier items): items saved in an earlier version of QRemo may still show a time marked "Estimate only". Such a time did not come from an official source and may be wrong; check it against the label, and change it or stop tracking the item if in doubt.
- Your own reminder (not checked by QRemo): for an opened medicine or infant formula, a date you pick yourself. QRemo does not fill it in, suggest it or check it.
- Set by you: for products other than medicines and infant formula, a time you entered or changed. QRemo does not check it.
- Barcode found by name: when a product is named from your photo and no barcode can be read, QRemo may search the databases listed above by brand, name and size, and its AI picks the entry that best matches and fills in that barcode (for medicines, only QRemo's own barcode table is searched). The app says where it was found. A product can have several barcodes (for example single items and multipacks), so it may differ from the code on your package; scan your own to replace it. A barcode found this way is never added to QRemo's barcode table.
More than one of the same product: each item you add is tracked on its own. When the same product is already open in your list (for example two bottles of the same milk), QRemo asks whether it is the same one or another one, and numbers the copies (#1, #2) with an optional tag of your own. QRemo cannot tell physical containers apart: mark each one (for example write its number on it) so you know which is which, and always check a product before use.
Medicines and infant formula: QRemo tracks a medicine or infant formula only by its printed expiry date, and only while the package is sealed or, for a medicine packed one dose at a time (for example blister packs, sachets or single-dose vials), while each dose is sealed. For these products QRemo uses only the name, the printed expiry date (read by AI from your photo, read from the square 2D code on some medicine packs, or typed by you) and, if there is one, the barcode, and it asks you to check the date against the package. Reminders for a medicine say that the printed date is valid only while it is sealed. Once a medicine or infant formula is opened, QRemo does not provide, suggest, estimate or read any after-opening time, whether from a label, a pharmacy sticker, a public database or AI. The app tells you that opened medicines aren't tracked and that you should follow the label, the leaflet or your pharmacist. Many medicines (for example mixed liquid antibiotics, insulin and eye drops), and infant formula once opened or prepared, must be used or thrown out long before the printed date. You may instead set "Your own reminder": a date you choose yourself, with nothing filled in by QRemo, shown in the app as "Your own reminder (not checked by QRemo)". QRemo does not check whether that date is right for your product. You can also stop tracking the item. A medicine saved in an earlier version of QRemo with an after-opening time taken from a pharmacy sticker, the official FDA label or a time picked from your own label shows a one-time notice; you can switch it to your own reminder or stop tracking it, and its source records are kept as described in section 14. The medicine cabinet check lists medicines that are near or past their printed date; it does not tell you whether an opened medicine is still good to use. If anything in the app differs from your product's label or your pharmacist's instructions, follow the label and your pharmacist.
Recall alerts (a Premium feature) use public recall data: in the United States from the FDA (openFDA food and drug enforcement reports), the U.S. Department of Agriculture's Food Safety and Inspection Service (USDA FSIS, for meat, poultry and egg products) and the U.S. Consumer Product Safety Commission. QRemo does not currently check U.S. Department of Agriculture (FSIS) recalls of meat, poultry and egg products, or recalls of medical devices. QRemo checks for new recalls about once a day and matches recalls published in roughly the last year against items still open in the app; matches are shown in the app and, when you allow notifications, the app also notifies you the next time it is open. Matching is automated, by barcode, brand and name, not by lot number, so it can miss a recall, be delayed, or match the wrong product or a lot that is not affected.
Every time shown from an official source, a label or the maker's website comes with the line "Follow the storage conditions on the product.": the time holds only if the product is stored as its label says (for example, refrigerated after opening). Any of these sources can be incomplete, out of date or wrong for your specific product. The label on your product and the advice of your pharmacist or doctor always come first.
Receipts, money and ideas: when you scan a receipt, AI reads the store, products and prices from your photo and can misread them; medicines and infant formula are left out so you add them one by one. "Money saved" is an approximate figure based on receipt prices or, when there is none, an estimate of the usual store price made by AI from the product's name, brand and size (or a typical price for its group); estimates can be far from what you paid. It is not financial advice. Recipe ideas (a Premium feature) are written by AI from the names of your food items only: the AI cannot see whether food is still safe, so look at and smell everything first, never use anything past its date, and check for allergies. Reminders about DEA Take Back Day are general information; QRemo is not affiliated with the DEA, and the DEA sets each date and site.
3. Not professional advice
QRemo is a reminder tool only. It does not provide medical, pharmaceutical, nutritional or food-safety advice and is not a medical device. Always follow the product label and the advice of your doctor, pharmacist or other qualified professional. This includes every after-opening time in the app, whether it comes from an official source, a label, you, or an estimate saved in an earlier version, and every reminder, including any reminder you set yourself. Do not rely on QRemo to decide whether a medicine, food, baby product or other item is safe to use. When in doubt, throw it out. Recall alerts, where offered, may be incomplete or delayed. QRemo is not affiliated with, or endorsed by, the FDA, USDA, the U.S. Department of Health and Human Services (FoodSafety.gov), CPSC or any other government agency. Government data is provided as-is, and the FDA states that its public data should not be relied on to make decisions about medical care. Always check the label of your specific product and lot number, and ask your pharmacist. In an emergency, call 911. For a possible poisoning, call Poison Control at 1-800-222-1222.
4. Your responsibilities
You are responsible for what you consume, use or give to others, for the accuracy of what you enter, and for keeping your account secure. You may only invite people you share your list with (for example family, roommates or coworkers) and may only upload photos you have the right to share. Take photos of products, their labels and receipts only, and do not include people or unrelated documents. QRemo does not ask for photos of pharmacy stickers or prescription labels. If one is on a medicine package you photograph, cover your name and prescription details if you can; QRemo uses that photo only to read the medicine's name and printed date (see the Privacy Policy).
5. Your content
You keep ownership of the photos and entries you add ("Your Content"). You grant us a non-exclusive, royalty-free licence to host, store, process and display Your Content to operate and improve the Service, and to create de-identified, aggregated statistics as described in the Privacy Policy. When you save a product with a barcode, you also allow us to add its barcode, name, brand, size and category to QRemo's barcode table, where other users can see them without knowing who added them. Aggregated statistics that cannot identify you or your shared list belong to us. Sharing your anonymous usage with brands and stores is a separate choice in the app: it is off by default, never required to use QRemo, and described in section 5 of the Privacy Policy.
6. Acceptable use
Do not misuse the Service, attempt to access other people's data, reverse-engineer it, scrape it or access it by automated means, get around scan allowances or other limits, create accounts to earn rewards, or use it for any unlawful purpose. To protect the Service, we limit how many requests each account can make in an hour.
7. Subscriptions and prices
Premium. Premium is a paid subscription sold through the Apple App Store or Google Play. Before you buy, the app shows the price, the billing period (monthly or yearly) and the length of any free trial. Prices are shown in U.S. dollars, plus applicable sales tax. One subscription covers everyone on your shared list (up to 6 people). While Premium is marked "coming soon", tapping a plan only records your interest and nothing is charged.
Automatic renewal. A Premium subscription renews automatically at the end of each billing period, at the price shown when you subscribed (or a new price you were told about as described below), and your app store charges your payment method for each period until you cancel. A free trial, if offered, turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends; if you cancel in time, you are not charged. Who can get a free trial is decided by your app store; usually it is one free trial per account.
How to cancel. You can cancel at any time in your app store account: on iPhone or iPad, Settings → your name → Subscriptions; on Android, Google Play → Payments & subscriptions → Subscriptions. If you subscribed yourself, Manage Subscription in the app opens these settings. Cancel at least 24 hours before the end of the current period to stop the next renewal; you keep Premium until the end of the period you paid for. Deleting the app or your QRemo account does not cancel a subscription. If you need help cancelling, write to support@qremo.com.
Refunds. Payments are processed by Apple or Google, and refund requests are handled by them under their policies. This does not limit any right to cancel or to a refund that you have under the law where you live (see section 13).
Price changes. We will tell you about any price increase at least 30 days before it applies to you, and your app store will ask for your consent where its rules or the law require it. If you do not agree, you can cancel before the new price applies. For a yearly plan, we will remind you in the app before each renewal, from 20 days before you are charged, with the price and how to cancel.
AI photo scans: naming a product from a photo or reading a receipt uses automated image recognition (AI), which costs us money for each scan, so each person has a monthly allowance of these "AI photo scans": 5 a month on the free plan, plus any extra you earn as described below, and a fair-use allowance of 50 a month with Premium. Photos of a printed date or of an after-opening instruction on a label, scanning a barcode, typing a product name and finding a barcode by name do not count toward this allowance. Allowances start over on the 1st of each month, unused scans do not carry over, and we may change them with notice in the app. Until store payments are available, these allowances may not be applied.
Teaching QRemo: on the free plan, when you save a product whose barcode is new to QRemo's barcode table and another shared list later confirms it, you get 1 extra AI photo scan in the month it is confirmed, up to 10 a month.
Earn Free Credit (invitations): you can share your personal invite code. When a new person enters it while signing up, finishes signing up and saves their first item, they count as invited by you. On the free plan, for every 2 people who join with your code in a calendar month you get 1 extra AI photo scan that month, up to 10 a month, and for every 10 people who join with your code, at any time, your shared list gets one month of Premium features, starting the day the 10th of them counts (if you already have Premium from invitations, the new month starts when the current one ends). Premium months from invitations cost nothing and do not renew automatically. A person can join with only one code, within 7 days of creating their account, and you cannot use your own code. When you share your code, make clear that you get a reward if people join (the message the app prepares says so), share it only with people you know, and do not send it as unsolicited bulk messages or post it so that it looks like an advertisement or review from QRemo. Rewards have no cash value and cannot be transferred, sold or exchanged for money. Accounts created only to earn rewards, or other misuse, do not count, and rewards earned through misuse can be removed. We may change or end the program with notice in the app; this does not take away Premium months or scans you have already earned fairly.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and accuracy of after-opening times or other shelf-life information, product recognition, reminders or recall information. Some states do not allow certain warranties to be excluded, so some of these exclusions may not apply to you. Nothing in these Terms excludes a warranty or guarantee that the law where you live says cannot be excluded.
9. Limitation of liability
To the fullest extent permitted by law, QRemo and its officers, employees and partners are not liable for any indirect, incidental, special or consequential damages, or for loss of data or profits, arising from use of, or reliance on, the Service. To the fullest extent permitted by law, our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or 50 U.S. dollars. Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence where the law does not allow it to be limited, for our fraud, gross negligence or wilful misconduct, or any other liability that cannot be limited or excluded under the law where you live (including California Civil Code section 1668). Some states do not allow these limits, so they may not apply to you.
10. Indemnity
To the extent permitted by law, you agree to indemnify QRemo against third-party claims arising from your breach of these Terms, your violation of the law or of someone else's rights, or Your Content. This section does not apply wherever the law does not allow it.
11. Ending your account
You can delete your account at any time in the app (Menu → Delete Account). Items on a list you share with others stay for them. Deleting your account does not cancel a subscription bought through an app store: cancel it there first (section 7). We may suspend or end accounts that break these Terms, and we will tell you why unless the law or the safety of others prevents it. [Lawyer to decide: refund of the unused paid period if we end an account for a reason other than a breach, or stop offering the Service.]
12. Changes
We may update these Terms. If changes are material we will notify you in the app at least 30 days in advance where the law requires it, and ask you to accept them in the app before you continue. If you do not accept them, you can stop using the Service, cancel any subscription and delete your account.
13. If you live in the United States
These Terms are governed by the laws of the State of California, without affecting consumer protections of your state. [Lawyer to decide: binding individual arbitration with a 30-day opt-out and a class-action waiver.]
California residents: under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
14. Records of where dates come from
For every date QRemo suggests or you save, and for every request to QRemo's AI or to the public databases, we keep a record of where it came from and what was asked: the source (an official source such as USDA FoodKeeper or FoodSafety.gov, product label, the maker's website, printed date, a time you set, or your own reminder; for items saved in an earlier version of QRemo, an estimate; and, for medicines saved in an earlier version of QRemo, the FDA drug label, a pharmacy label or a time picked from your own label), the public data used and its version (for example the FoodKeeper dataset version or, for those earlier medicines, the FDA label's identifier and version), what was sent (for example text you typed, the barcode scanned, or the names of items sent for recipe ideas), what came back (for example the product named, or the store and products read from a receipt, without the prices), the text quoted or read (for example the after-opening line read from a product label or the date read from a package and, for those earlier medicines, the sentence quoted from the FDA label or the line read from a pharmacy sticker), the automated checks and whether they passed, the AI model used, the date and time, your account identifier, and the version of these Terms you had accepted. For a lookup on the maker's website, the record also keeps the page address, the sentence quoted from that page and the time, along with the product details sent, the search results, whether each check passed and, for a shared result (section 2), when it was checked. Photos are not part of these records. The records cannot be changed or deleted from the app. We keep them for [3 years] so that we can show what the app displayed and why, including in a dispute; if you delete your account, we remove your account identifier from them. Your rights over these records are described in the Privacy Policy.
15. App stores
If you downloaded QRemo from the Apple App Store or Google Play, these Terms are between you and QRemo only, not Apple or Google. QRemo, not Apple, is responsible for the app and its content, and Apple has no obligation to provide maintenance or support for it. To the maximum extent permitted by law, Apple has no other warranty obligation for the app; if the app fails to conform to a warranty that applies, you may notify Apple, and Apple will refund any purchase price you paid for the app. QRemo, not Apple, is responsible for handling any claim about the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, claims under consumer protection, privacy or similar laws, and claims that the app infringes someone else's intellectual property. You confirm that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties. You must also follow the app store's terms that apply to you. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Data sources and licences
QRemo uses public and open data, and none of these providers endorses QRemo: USDA FoodKeeper and USDA FoodData Central (U.S. Department of Agriculture); the Cold Food Storage Chart on FoodSafety.gov (U.S. Department of Health and Human Services), for after-opening times; openFDA and the National Drug Code Directory (U.S. Food and Drug Administration), used to name medicines from their barcode and, for openFDA, for recall data; recall data from the USDA Food Safety and Inspection Service and the U.S. Consumer Product Safety Commission; and barcode data from UPCitemdb.com. Product information from Open Food Facts, Open Beauty Facts, Open Pet Food Facts and Open Products Facts is © their contributors and is made available under the Open Database License (ODbL) v1.0 (https://opendatacommons.org/licenses/odbl/1-0/); where QRemo shows or uses that information, it is credited to its source. Information from FoodSafety.gov is a work of the U.S. federal government and is in the public domain in the United States.
